TERMS AND CONDITIONS OF USE OF THE SITE
Access to and use of this website www.giampieronicola.com (hereinafter “the Website”) is governed by these Terms and Conditions of Use (hereinafter “Terms of Use”). The Website is owned by GNV Srl, registered in the Fermo Companies Register under No. 01338800442, tax code/VAT number 01338800442, and with registered office at Via Pola No. 1, 63812, Montegranaro (FM), which uses it to promote and sell its products to consumers online. GNV Srl may modify these Terms of Use and the content contained therein (including, but not limited to, prices, images, videos, text, and product information) at any time, without notice. Visitors and users of the Site (hereinafter “the User”) are therefore required to review the current Terms of Use before using the Site. Any changes to the Terms of Use will be effective upon publication on the Site and will apply only to access to the Site after publication. These Terms of Use are also available in English. In the event that the English translation of the Terms of Use differs from the meaning given in the Italian version, the meaning and interpretation given in the Italian version shall prevail. By accessing the Site, the User fully and unreservedly acknowledges and accepts these Terms of Use.
INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The Site, its associated domains and subdomains, and all content contained therein, including but not limited to trademarks, logos, descriptions, text, graphics, data, drawings, models, photos, and videos, are the exclusive property of GNV Srl, protected by copyright and subject to the protections provided by applicable intellectual and industrial property laws. The User may therefore download, store, and use the material contained on the Site for exclusively personal, non-commercial purposes, unless expressly authorized in writing by GNV Srl. The User may not reproduce, publish, or distribute the contents of the Site and its associated domains without express authorization from GNV Srl. Ownership, title, or any other rights to the contents of the Site and its associated domains are not in any way transferred to the User upon visiting, using, or purchasing products from the Site.
SITE ACCESS AND USER OBLIGATIONS
The User may use the Site without creating a personal account or, alternatively, if available, access the reserved area with their unique credentials. If a personal account is created, the personal data entered by the User during registration will be processed in compliance with current privacy legislation, as further detailed in the information published in the privacy and cookie policy section of the Site (link). The User is advised to take the utmost care when completing the registration form to avoid any misunderstandings for which GNV Srl cannot be held responsible. The User may be asked to subscribe to the newsletter, which will allow them to receive communications, updates, offers, or other initiatives promoted by GNV Srl. Using the Site in an improper or unlawful manner that prevents, alters, damages, or compromises the proper functioning of the Site and its content is prohibited. In particular, violating the security and authentication systems is prohibited of the Site, inserting viruses, programs, or materials into the Site that could cause any type of technical, IT, or functional damage to the Site and its contents. The User is also prohibited from inserting or disseminating through the Site any material that is unlawful, offensive, defamatory, hateful, or discriminatory, or contrary to public order, morality, or the law. The User must act in compliance with these Terms of Use and applicable laws, under penalty of temporary or permanent suspension of use of the Site, even without notice.
SUBMISSION OF USER MATERIAL VIA THE SITE. PRIVACY
Any material, including but not limited to text, reviews, suggestions, photos, and videos (hereinafter “the Material”) submitted by the User via the Site is not to be considered confidential or the property of the User. The User therefore acknowledges that GNV Srl has the right to use, copy, distribute, and publish the Material for any purpose, including commercial purposes, without limitation or notice. The User guarantees and is responsible for ensuring that the Material submitted does not violate any third-party rights (copyright, trademarks, patents, know-how, etc.).The aforementioned Material does not include the User’s personal data, which will be processed in accordance with applicable privacy legislation, as further detailed in the information published in the privacy and cookie policy section of the Site (link).
LIMITATIONS OF LIABILITY. THIRD-PARTY SITES
GNV Srl is commited to ensure that the Site’s content is as complete and accurate as possible. However, despite adopting the utmost diligence, GNV Srl does not guarantee the non-infringement of third-party rights, omissions, or inaccuracies in the information and descriptions of the Site’s products and content. GNV Srl also reserves the right to temporarily or permanently suspend use of the Site, even without notice. GNV Srl cannot therefore be held liable for any damages incurred by Users who have relied on information on the Site, and is not liable for any damages to Users and/or their devices caused by malfunctions or interruptions of the Site that prevent its proper functioning. GNV Srl takes all reasonable measures to ensure that the Site is accessible to the User free of viruses, worms, Trojans, malvertising software, or other harmful elements. APPLICABLE LAW. JURISDICTION. DISPUTE RESOLUTION
Any disputes arising between GNV Srl and the User in relation to these Terms of Use are governed by Italian law, also in accordance with Article 6, paragraph 2 of EC Regulation No. 593/2008. In the event that the user of the Site is a consumer as defined by the Consumer Code (Legislative Decree 206/2005), the application of any mandatory and more favorable provisions of law in the User’s country of residence shall remain unaffected, as a safeguard for the User who is a consumer and has his or her habitual residence outside of Italy.
Pursuant to Article 20 of the Italian Code of Civil Procedure and EU Regulation No. 1215/2012, in the event of disputes arising between GNV Srl and the User in relation to these Terms of Use, the competent court shall be the court where GNV Srl has its registered office, i.e., the Court of Fermo. Pursuant to Article 66-bis of the Consumer Code, in the event of disputes arising between GNV Srl and the User in the capacity of a consumer in relation to these Terms of Use, the competent court shall be the court where the User is resident or domiciled, if located in Italy. If the consumer is resident or domiciled outside of Italy, he or she may alternatively appeal to the court of his or her place of residence or domicile or to the Court of Fermo in the district where GNV Srl has its registered office. The parties undertake to use their respective means to avoid legal disputes by promoting out-of-court resolution. The User may submit any complaints to GNV Srl, either via certified email (PEC) or registered mail with return receipt to the registered office of GNV Srl, which undertakes to respond to the complaint within 30 days. If the complaint is unsuccessful, the User is informed of the possibility of resorting to alternative dispute resolution methods
